This article proposes that the social function of judges has evolved in line with the changes that have occurred in our societies, and so it must always be contextualised. The basic guarantee which judges should provide from the point of view of their social function is translated into offering a solution to the conflicts of legitimate rights and interests, and therefore the achievements must be viewed on the basis of the kind of judge acting in each case. Nonetheless, it can (...) be seen that, in practice, a number of obstacles exist which prevent this provision from being real and effective and this makes it necessary to address this issue. This work studies the issue of political representation from the perspective of a specific legal culture, the exercise of political rights in the context of the occidental democratic system, a concept that has undergone a profound evolution to the present day. The essential aspects for an analysis of this progression are voting, decision making, and the relationship between representatives and their constituents. Overall, the phenomena making up the crisis of representation have been explained as a result of changes that have (...) affected the operation and structure of modern states constituted as representative democracies. The idea is that a well-functioning representative system comes primarily from the form of government and electoral system in which it develops. (shrink)

This article attempts to analyze the deconstruction of the linear organization of legal systems into a plurality of organized networks conform a circular systemic organization. As we know, the process of systematization runs parallel to the evolution of the modern State and, in this sense, the structure constitutes a single and well defined corps. However, at present, the emergence of multiple legal networks has been seen to turn Law into a structure that translates into a plethora of information that is (...) hard to nuance. Finally, with respect to the emergence of reflexive law, such reflexivity is feasible only when the processes of democratization create discursive structures in social subsystems, so the main problem is to deal with is their identity within a dynamic process of inter-legalities. En este trabajo se analizan, por una parte, los datos sobre la presencia de las mujeres en los movimientos de derechos de los animales en el estado español; por otro lado, tratamos de encontrar marcos explicativos que aclaren cuál es el vínculo que conecta la sensibilidad feminista con la sensibilidad animalista. Hemos realizado un sondeo sobre el porcentaje de mujeres entre los miembros de las organizaciones animalistas más importantes de España y, con estos resultados, hemos hecho una revisión de los (...) diferentes marcos teóricos que pueden explicar esta significativa orientación de género en la defensa del bienestar animal. Por último, defendemos que hay un vínculo entre la ideología patriarcal y la explotación ecológica, en tanto que ambos comparten la dominación y la opresión de género. En este sentido, la sensibilidad animalista movilizaría sentimientos morales de fraternidad con la naturaleza. (shrink)

Nowadays, Artificial Intelligence (AI) is present in all sectors of the economy. Consequently, both data-the raw material used to build AI systems- and AI have an unprecedented impact on society and there is a need to ensure that they work for its benefit. For this reason, the European Union has put data and trustworthy AI at the center of recent legislative initiatives. An important element in these regulations is transparency, understood as the provision of information to relevant stakeholders to support (...) their understanding of AI systems and data throughout their lifecycle. In recent years, an increasing number of approaches for documenting AI and datasets have emerged, both within academia and the private sector. In this work, we identify the 36 most relevant ones from more than 2200 papers related to trustworthy AI. We assess their relevance from the angle of European regulatory objectives, their coverage of AI technologies and economic sectors, and their suitability to address the specific needs of multiple stakeholders. Finally, we discuss the main documentation gaps found, including the need to better address data innovation practices (e.g. data sharing, data reuse) and large-scale algorithmic systems (e.g. those used in online platforms), and to widen the focus from algorithms and data to AI systems as a whole. In the first part of this article, we show that, contrary to the Gricean tradition, inter-clausal and is not semantically equivalent to logical conjunction and, contrary to temporal approaches such as Bar-Levand Palacas 1980, it is not temporallyloaded. We then explore a commonsenseidea – namely that while sentence juxtaposition might be interpreted either as discourse coordination or subordination, and indicates coordination. SDRT already includes notions of coordinating and subordinating discourse relations (cf. Lascarides and Asher 1993, Asher 1993), and the meaning (...) of and is related to this distinction. Similar distinctions that play a crucial role in anaphora resolution have also appeared in AI – cf. Scha and Polanyi 1988, or Webber 1991. However, this discourse-structure-based distinction has not been well defined yet, and our approach provides independent motivation for it. This paper argues that the semantics of and includes a notion of coordination expressed as the requirement of a Coordinated Discourse Topic (CDT).CDT characterizes aclass of discourse relations, among which are Narration and Result.Once the basic semanticcontribution of and is isolated, effects related to its presence such as changes in temporal structure, blocking of a Discourse Relation, or conditional meanings are shown to follow from the defeasiblearchitecture set up by SDRT. This study focuses on latent inhibition, a mechanism behind selective attention, as the biological basis of creativity in schoolchildren. The main objective of this study is to know if low levels of attention positively affect the levels of creativity manifested in students between the ages of nine and 12. The design of this study is non-experimental with an explanatory-correlational cross-sectional quantitative approach. In order to achieve the objective suggested, several education centers located in Murcia were selected, in which 476 students (...) took part in a creativity test, an attention test, and another test about intelligence depending on the educational level. The results obtained showed that selective attention was negatively correlated with graphic creativity, understanding that behind it lies the latent inhibition, and that when certain levels of intelligence are present, this negative correlation increases. In this way, the simultaneous existence of creative and inattentive subjects is demonstrated. (shrink)

According to the continuity hypothesis of dreaming and contemporary psychodynamic approaches, dreams reflect waking life. The aim of the present study was to explore the relationship between the COVID-19 pandemic and dreaming in adolescents. A cross-sectional survey was conducted in Italy, Romania and Croatia involving 2,105 secondary school students. No substantial differences between countries were found. Thirty-one percent of the participants reported heightened dream recall, 18% noticed an increase in nightmares during the lockdown, and 15% of the provided dreams included (...) pandemic-related content. The results indicate that subjective emotional reactions to lockdown had a significantly higher correlation to dreaming than objective distress. These findings suggest that attention to dreams should be included in preventive programs for adolescents with pandemic-related stress. (shrink)

The COVID-19 pandemic has impacted medical care in many ways; previously, a patient would enter a hospital and had an approximate idea of what would happen upon his admission, the physician informed them about it, but in the last two years this scenario has changed. Therefore, our aim was to identify if bioethical principles are present in the physician–patient relationship and the effect of these in the health care provided, through an observational and descriptive study where patients answered the validated (...) ReMePaB questionnaire that measures the presence of bioethical principles in the physician–patient relationship, on the seventh day of their hospital stay and 24 h after discharge, during the period from 1 August to 5 November 2020. In autonomy, an improvement in the score was observed in the second application compared to the first measurement; in the principle of non-vulnerability, the same scenario was observed for the first and second measurements, respectively. In the principles of beneficence, dignity, and justice, no statistically significant differences were observed. Considering the presence or absence of bioethical aspects in health care in this pandemic creates an area of opportunity to know the feelings of the patient during the care received and to maintain what is done well and improve those aspects that can be improved. Despite recent efforts by the Artificial Intelligence (AI) community to move towards standardised procedures for documenting models, methods, systems or datasets, there is currently no methodology focused on use cases aligned with the risk-based approach of the European AI Act (AI Act). In this paper, we propose a new framework for the documentation of use cases that we call use case cards, based on the use case modelling included in the Unified Markup Language (UML) standard. Unlike other documentation methodologies, we (...) focus on the intended purpose and operational use of an AI system. It consists of two main parts: firstly, a UML-based template, tailored to allow implicitly assessing the risk level of the AI system and defining relevant requirements, and secondly, a supporting UML diagram designed to provide information about the system-user interactions and relationships. The proposed framework is the result of a co-design process involving a relevant team of EU policy experts and scientists. We have validated our proposal with 11 experts with different backgrounds and a reasonable knowledge of the AI Act as a prerequisite. We provide the 5 use case cards used in the co-design and validation process. Use case cards allows framing and contextualising use cases in an effective way, and we hope this methodology can be a useful tool for policy makers and providers for documenting use cases, assessing the risk level, adapting the different requirements and building a catalogue of existing usages of AI. Currently, the concept of the cell as a society or an ecosystem of molecular elements is gaining increasing acceptance. The basic idea arose in the 19th century, from the surmise that there is not just a single unit underlying an individual’s appearance, but a plurality of entities with both collaborative and conflicting relationships. The following hypothesis is based around this model. The incompatible activities taking place between different original elements, which were subsumed into the first cell and could not be (...) eliminated, had to be controlled very closely. Similarly, a strong level of control had to be developed over many cellular elements after the cell changed its genome to DNA. We assume that at least some of those original RNA agents and other biomolecules which carry incompatibilities and risks, are retained within current cells, although they are now under strict control. A virus functions as a signal informing these repressed cellular RNAs and other elements of ancient origin how to restore suppressed degrees of molecular freedom, favoring pre-existing molecular affinities and activities, re-establishing ancient molecular webs of interactions, and giving fragments of ancient coded information the opportunity to be re-expressed. Collectively, these newly activated mechanisms lead to different possibilities for pathological cell states. All these processes are opposed by cell-control mechanisms. Thus, in this new scenario, the battle is considered intracellular rather than between the virus and the cell. And so the virus is treated as the signal that precipitates the cell’s change from a latent to an active pathological state. (shrink)

In this article I explain the origin of the concept “postsecular”. I argue that such concept, spread by Jürgen Habermas since 2001, has its origin in the reformist Jewish thought from 70’s in the United States. In this context, the postsecular is drafted as a phase which Jewish Theology is experiencing as result of its contact with secular lifestyle. Such contact summons to a reflection on ethic values which secularization missed. I argue that some of the meanings of the current (...) concept of “postsecular”, which Habermas articulates, were already present in the first uses of such concept from Eugene B. Borowitz and Emil Fackenheim. Finally, I argue that it might be set up a correlation between the ethical origins of the postsecular and the Habermas’s as “awareness of what is missing”. (shrink)

The purpose of this work is to take Mary as the subject of a life of contemplation, to observe her manner of relating with God, of speaking to His messengers and of praising Yhwh. She is a daughter of Israel who speaks to the God of her people and interprets His figure according to that tradition. The questions we will attempt to answer are: with what God did she relate? Where did their encounters take place? How did she regard her (...) person in relation to the divinity? To what degree did her son’s life affect her understanding of God? We do not know her feelings nor her reactions at the Cross but by following Old Testament patterns I am going to offer possible conjectures. Rather than present Mary simply as an object of biblical contemplation I want to give the model of Marian spirituality that can serve as a personal path for Christians so that her figure as summa contemplatrix becomes that of illuminatrix, helping us to enter into a relationship with God and discover the whole range of possibilities that this offers.2. As the physical world becomes tamed and mapped out, opportunities to experience the unknown become rarer; imaginary worlds provide a much-needed sense of potentiality. Potentiality is central to the Self-Other Re-organization theory of cultural evolution, which postulates that creativity fuels cumulative cultural change. We point to evidence that fear affects, not the magnitude of exploration, but how cautiously it proceeds.

8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. The use of images in education has received little attention despite the dual role of images in school textbooks, one aimed at the acquisition of knowledge and the other at the transmission of attitudes, values and norms, that constitute a valuable source of historical, educational and communicative research. We will study, through the analysis of content, the characteristics of the catechisms, the legislation of the time related to the publication of school textbooks, the presence of images, types, the didactic function (...) and the transmission of social models and ideology. The research suggests that the images of school catechisms are not simply reflections of a reality that facilitates the learning of the contents taught in schools, but that they also become an effective tool in the transformation of the values and ideological thinking of the social context in which they are produced. Risk-taking behaviors in adolescents have traditionally been analyzed from a psychopathological approach, with an excessive emphasis on their potential costs. From evolutionary theory we propose that risk-taking behaviors can be means through which adolescents obtain potential benefits for survival and reproduction. The present study analyses sex differences in three contexts of risk in the evolutionary specific domains and the predictive value of these domains over risk-taking behaviors, separately in female and male adolescents. 749 adolescents valued their risk perception, expected benefits (...) and risk propensity through the Evolutionary Domain-Specific Risk Scale, as well as their engagement in risk-taking behaviors through the Risky Behavior Questionnaire. Male adolescents showed lower risk perception in two evolutionary domains, expected higher benefits in two other domains and showed higher risk propensity in six domains. Female adolescents showed lower risk perception in two domains. Additionally, risk perception, expected benefits and risk propensity in the evolutionary domains predicted the engagement in risk-taking behaviors in male adolescents, whereas in female adolescents only expected benefits and risk propensity showed a predictive effect over risk-taking behaviors. These results suggest the potential role of evolutionary mechanisms on risk-taking behaviors in adolescents. Results have practical implications for interventions programs aimed at reducing risk-taking behaviors. In addition to considering sex differences, intervention programs should consider alternative behaviors through which adolescents can reach their evolutionary goals, and handle the risks related to those behaviors that cannot be replaced but have potential benefits for adolescents. Background: Serious games have shown positive results in increasing motivation, adherence to treatment and strengthening the therapeutic alliance in multiple psychiatric disorders. In particular, patients with impulse control disorders and other disorders in which the patient suffers from inhibitory control deficits have been shown to benefit from serious games.Aim: The aim of this study was to describe the characteristics and to evaluate the usability of a new serious videogame, e-Estesia. This serious videogame was designed to improve emotion regulation in patients (...) with gambling disorder. Preliminary results from a pilot sample are also reported.Method: A pilot sample of 26 patients undergoing treatment for GD was recruited. Participants used e-Estesia on a tablet, which was connected to a thoracic band that sent heart rate and heart rate variability data to the videogame platform in order to provide biofeedback. The System Usability Scale was completed by patients to determine the usability of e-Estesia.Results and Discussion: e-Estesia performed comparatively well for all the explored groups. Around 84.6% of the patients endorsed that it was easy to use. Female patients with GD presented higher HRV during the use of the serious videogame compared to men. (shrink)

Recent research has shown that cultural, linguistic, and sociodemographic peculiarities influence the measurement of trait emotional intelligence. Assessing trait EI in different populations fosters cross-cultural research and expands the construct’s nomological network. In mental health, the trait EI of clinical populations has been scarcely researched. Accordingly, the present study examined the relationship between trait EI and key sociodemographic variables on Trait Emotional Intelligence Questionnaire datasets with mental healthcare patients from three different Spanish-speaking countries. Collectively, these datasets comprised 528 participants, 23% (...) from Chile, 28% from Peru, and 49% from Spain. The sociodemographic variables we used for trait EI comparisons were gender, age, educational level, civil status, and occupational status. Analyses involved Multigroup Exploratory Structural Equation Modelling and analysis of covariance. Our results revealed significant between-country differences in trait EI across the studied sociodemographic variables and interactions between these variables. Measurement invariance across the datasets was attained up to the scalar level regarding gender and education, although analyses on age, civil status, and occupation displayed non-invariance. The resultant psychometric evidence supports the suitability of the TEIQue-SF for the accurate cross-cultural assessment of trait EI in mental health settings. It also highlights the importance of incorporating trait EI into extant psychotherapeutic frameworks to enhance non-pharmacological treatment efficacy. (shrink)

Cognitive symptoms after COVID-19 have been increasingly recognized several months after the acute infection and have been designated as “brain fog.” We report a patient with cognitive symptoms that started immediately after COVID-19, in which cerebrospinal fluid biomarkers were highly suggestive of Alzheimer’s disease. Our case highlights the need to examine patients with cognitive symptoms following COVID-19 comprehensively. A detailed assessment combining clinical, cognitive, and biomarker studies may help disentangle the underlying mechanisms associated with cognitive dysfunction in each case.
